This contract (hereafter the Contract) describes the conditions of use of the PLANET REBATES placed at the disposal by The Montecito Group, SAS with a capital of 40.000 €, registered with and the Company Trade register of Caen (France) (hereafter called We, The service).

This Contract defines the conditions of your registration and your use of the Service PLANET REBATES (such as definite below).

1. DEFINITIONS

Within these conditions, the following terms or expressions are used with the meaning given below:
PLANET REBATES: refers to the website www.PlanetRebates.com exploited by company The Montecito Group, and accessible to URL www.PlanetRebates.com
Member: indicates any person who has opened an account on PLANET REBATES, having or not carried out an online purchase one of web sites merchants partners of PLANET REBATES.
Merchants partners: are the web-based merchants that are available through our service and eligible for cash-back and promotions through PLANET REBATES.
Active member: member who carried out a purchase over the last 365 days.
Team: a group of at least 5 members linked by an invitation.
Godfather member: Member who has invited another person to join the PLANET REBATES service
Godchild: Member who has been invited by another member to register to the PLANET REBATES service
Active Godchild: Godchild who has spent via the PLANET REBATES service more than $100 (excluding VAT and shipping) on its online purchases.
Sub Godchild: Godchild of a godchild member of the service
Active Sub Goldchild: Goldchild who has spent more than $100 (excluding VAT and shipping).

2. ACCEPTANCE OF THE PURPOSE

At the time of your registration to the service, the member fully admits having consulted, having understood and accepted all information and conditions of this contract by checking the box indicating the sentence I read, understood and I accept the terms and conditions of the PLANET REBATES service. located at the bottom of the registration form to validate it. Without accepting the term and conditions, it is not possible for anyone to use the services offered by PLANET REBATES. These Terms and conditions will prevail on all other conditions appearing in any other document, except preliminary, express and written exemption.

3. THE PLANET REBATES SERVICE

3.1 Access to the service

The PLANET REBATES is open to any legal entity or natural person, over 18 years old. The inscription is done through the website www.PlanetRebates.com.

3.2 Service purpose

PLANET REBATES is a free web-based service that provides its members with rebates on their online purchases. The rebates are given through cash back. The amount of rebates varies from one shop to another. Rebates can be a fixed amount which depends on the type of purchase and on the shop where members buy or a percentage of the total amount of your purchase without tax and shipping fees.

The member receives additional cash back if he/she belongs to a team or if he/she has invited people to join PLANET REBATES, as this is defined below in the article 3.3.2 Team rebates.

3.3 Rebates offered

3.3.1 : Individual rebates

A member earns individual cash back with each online purchase done with merchant partners of PLANET REBATES. This cash back is credited on the members PLANET REBATES account.

Amounts of individual cash back for each shop are indicated on the PLANET REBATES website. It is the rate available at the time of the purchase which will be the one applied to determine the cash back earned by the member.

3.3.2 : Team rebates

Each time a member purchases from one of our partners, in addition to the individual rebate, he/she will get an additional rebate will be credited to the team account.

Members can refer to the individual shop page to find out the level of additional rebate available for each shop. It is the rate available at the time of the purchase which will be the one applied to determine the cash back earned by the member.

If the rebate is a percentage, the rebate is calculated on the total amount of the purchase excluding tax and shipping fees.

Each calendar trimester, the total amount rebate balance of the team is, divided equally among the members of the team who have spent more than $75 excluding VAT and shipping. If no member reaches this amount of expenditure in the previous trimester, the amount is deferred to the next trimester.

3.3.3 : Benefits of the Ambassador program

Any Member can invite people to join the PLANET REBATES service. If an invited person accepts that invitation and successfully becomes a member of the service then the inviter becomes thus automatically member of the program of sponsorship called Ambassador Program PLANET REBATES.

The account of the Godfather Member will then be automatically credited with the bonus offer whose specific conditions are indicated in the heading Ambassador program on the www.PlanetRebates.com website.

Each new online purchase of a godchild or sub godchild provides the godfather with an additional rebate which is credited to his account. The amounts and conditions of attribution of these benefits are specified in the heading Programs Ambassador of the www.PlanetRebates.com website.

When a member invites a person to join the PLANET REBATES service using the invitation form of its account, the Member is the only person responsible in all aspects of any consequences related of the sharing of the persons personal data.

3.3.3 : Modification of the rebates provided

PLANET REBATES may modify the principle and the amount of cash back provided to individual members, teams and godfathers at any time.

The amount of cash back given to any member for his/her individual purchases or his/her team are viewable on the www.PlanetRebates.com website in the heading My Account.

4. REGISTRATION AND USE OF THE SERVICE

4.1 : Registration Validity

Registration to PLANET REBATES is open and free of charge to any person older than 18 years old. The member must fill all the mandatory fields of the registration form in order to validate his registration.

4.2 : Account uniqueness

One and only one account per person is allowed. In case of fraud PLANET REBATES reserves the right to delete the concerned accounts: all associated rebates collected on the various accounts will be definitively lost.

4.3 : PLANET REBATES login

During the registration process, the member is invited to choose a personal login as well as a password which will be used to identify himself/herself to use the various services of PLANET REBATES. The login is unique. Therefore, if the login chosen by the member is not available, the member has to choose a new one. If the member is free to choose his login, PLANET REBATES reserves the right to refuse any login with any racist, xenophobe, defamatory, abusive connotation. The same rules apply for teams' name.

4.4 : Attribution and use of the PLANET REBATES email address

Once the login has been validated, a login@planet-rebates.com email address type is allotted to the Member. This email address has to be used by the Member for his online purchases in the order form so that cash back can be credited on the member account. If the member fails to use this specific email account provided by PLANET REBATES then no rebate will be collected to the benefit of that specific member. This email account is only for use of PLANET REBATES any other use (including, but not limited to uses like personal email, exchanging information among others, etc) is prohibited and the provider of PLANET REBATES cannot be held liable , under any circumstances, for breaching the members personal data classified, by accessing the content of these specific email accounts.

During the purchasing process with one of the on line merchants, PLANET REBATES receives the confirmation email at the email address mentioned above. This email is then processed and stored in the member personal account so that the rebate can be credited to his/her account.

This email is also immediately forwarded to the regular email address that the Member has specified during his/her registration to the service, and so it is supposed to be known to the member thereafter. The Member is responsible for providing valid email address: in case of change of his email address or internet service provider, he/she must update his/her profile on his/her PLANET REBATES account.

PLANET REBATES cannot be held responsible for any possible loss of email and information inherent in this loss, if the Member does not ensure the validity and availability of the email address appearing in his PLANET REBATES profile.

4.5 : Use of order confirmation emails content sent to your login@planet-rebates.com email address

Members authorize PLANET REBATES to use the content of order confirmation emails sent by the merchants to determine the amount of the cash back earned by the user. The cash back is then credited on the members account if the Member has followed the procedure required to earn cash back with PLANET REBATES.

5. OBTAINING AND PAYMENT OF THE CASH-BACK

5.1 : Obtaining cash back

To earn cash back on his purchases, the Member must obligatorily respect the following steps:
1.Login to www.PlanetRebates.com
2.Browse the categories of shops to find the store where he/she wants to shop, and then clicks on the provided link
3.Use his/her login@planet-rebates.com email on the order form of the shop instead of his/her personal email address

PLANET REBATES will then receive the confirmation of the members order and process his/her rebates. The member will then receive the order confirmation email sent by the online merchant directly to his/her personal email address specified in his PLANET REBATES account.

The cash back will not be credited to the members account if the member has entered another e-mail address than login@planet-rebates.com during his order.

5.2 : Account credit and rebate validation

When the Member has followed the procedure stated in the article 5.1, the cash-back is credited to the member account within 5 working days.

The member's rebate/cashback is processed once the online merchant has confirmed payment, product delivery and no item return and once the online merchant has paid PLANET REBATES for the corresponding commission. If the member returns one item from an order of several items, his/her rebate will be recalculated to exclude the returned item. If the member has ordered only one item and has decided to return it, no rebate will be received. This confirmation can take up to 8 weeks after the return policy deadline of the specific merchant. If the online merchant can not confirm or pay the commission to PLANET REBATES, the associated rebates stay pending.

5.3 : Payment of the cash-back

A purchase done respecting the steps underlined in the article 5.1 is considered as qualifying for the minimum amount of payment except if the opposite is mentioned. During exceptional promotions, a part of the cash back earned can thus be considered as not qualifying for the threshold of payment. The member will be specifically notified for such purchases.

The member will receive his/her money each time his/her PLANET REBATES account accumulates $20 in rebates from his/her own qualifying purchases. During exceptional operation, this minimum amount could be modified.

The various methods of payment available are indicated on the members PLANET REBATES account.

Payments will be processed within 30 working day following members request.

6. LIABILITY OF PLANET REBATES

6.1 Availability of the service

PLANET REBATES endeavors to make its service available 7 days a week and 24 hours a day. However, PLANET REBATES could temporarily stop the service for maintenance or any other reason. PLANET REBATES could not be held responsible for it and will as far as possible endeavors to inform its Members before an update or maintenance action.

In the same way, PLANET REBATES could not be held responsible for a partial or total failure, for access problem to PLANET REBATES due to the failure of the members Internet service provider, neither for the congestion of the Internet network or for all other external reasons with PLANET REBATES.

PLANET REBATES could not be held responsible for the loss of emails. The Member must in ensure that his email address is valid.

6.2 Membership cancellation

PLANET REBATES reserves the right to cancel the membership if the member does not comply with the rules of correct use of the service or harm the service. His/her account will then be closed and the account balance sent via a letter to the memberís address indicated on his account.

6.3 Relations with the merchants associated with PLANET REBATES

PLANET REBATES just acts as an intermediary service that provides its members with the best possible collection of rebates and offers for online shopping.

PLANET REBATES does not interfere with the customer service of online merchant. PLANET REBATES could not be held responsible or liable for any commercial dispute between a Member and a merchant related to a purchase carried out via our service.

7. PROTECTION OF YOUR PERSONAL DATA

PLANET REBATES endeavors to protect your personal data to the maximum. The Member can read the Privacy Statement available on the www.PlanetRebates.com website.

8. SERVICE CHANGE OR CHANGE IN THE TERMS AND CONDITIONS

PLANET REBATES reserves the right to modify or update constantly the pages of www.PlanetRebates.com, the services offered, or the terms and conditions applicable. Members are thus invited and suggested to read the most recent version of Term and conditions on the www.PlanetRebates.comwebsite each time they use PLANET REBATES. Notification of any modification will be notified by email to the email address specified in his PLANET REBATES account.

9. APPLICABLE LAW DISPUTE

The PLANET REBATES Terms and Conditions are subjected to, interpreted and applied in accordance with, the French law. All disputes will be the competence of the court of Paris, France, whatever the residence of the defender may be.
